These general conditions of sale apply to all orders placed on or with the website www.clamouse.com

The clamouse.com website offers the Customer the sale of :

  • Adult ticket for the visit of the Clamouse Cave,
  • Ticket at discounted rates for the visit of the Clamouse Cave,
  • Child 3 to 12 years ticket for the visit of the cave of Clamouse,
  • Child under 3 years (free) ticket for the visit of the cave of Clamouse,
  • Article "Audioguide for foreigners and the hearing impaired" for the visit of the Clamouse cave.
  • Ticket "Speleopark 1 Adult" for the Speleopark 1 route of the Clamouse cave.
  • Ticket "Speleopark 1 Child" for the Speleopark 1 route of the Clamouse cave.
  • Ticket "Speleopark 2" for the Speleopark 2 trail in the Clamouse cave.
  • Article "Adult session 5 to 10 people" for the Serious Game activity in Clamouse.
  • Article "Family session 5 to 12 people" for the Serious Game activity in Clamouse.
  • Article "Children's session 5 to 12 people" for the Serious Game activity in Clamouse.
  • Article "Additional person" for the Serious Game activity in Clamouse.

Any placing of an order on the site www.clamouse.com assumes knowledge of these terms and conditions of sale and the Customer’s agreement in their entirety.

La grotte de Clamouse reserves the right to adapt or modify these terms and conditions of sale at any time.
In this case, only the general conditions of sale in force when the order is taken will then be applicable. La grotte de Clamouse advises the Customer to save and / or print these terms and conditions for safe and sustainable storage, and thus be able to invoke them at any time during the execution of the contract if necessary.

Article 2 – PRICE

All prices of products and services offered for sale on the site www.clamouse.com and current brochures are expressed in euros with all taxes included.

La grotte de Clamouse reserves the right to change prices at any time but agrees to apply the rates in effect at the time of registration of the order subject to the availability of products on that date. The prices listed on the website and the brochures of the current year are applicable until the closing date for holidays of la grotte de Clamouse.

The products remain the property of la grotte de Clamouse until full payment is received. However, from the time the order is picked up or received by the customer or his representative, risks related to carriage are transferred to the customer.

Article 3 – ORDERING AND CONFIRMATION

You declare to have read and accepted these terms and conditions before placing your order.

The contractual information is presented in French.

To place an order, the Customer follows the various stages of order scrolling on the site, namely:

  • Click on the “online ticketing" tab or on the “Buy your tickets" tab
  • Select the activity for which you wish to purchase tickets.
  • Please note that there is no right of withdrawal and click on "I accept".
  • Select the type and number of tickets desired in the "Prices" section and click on "Next".
  • Choose the date on which the Customer wishes to come and the time of the beginning of his activity.
  • Complete the "Your information" tab and click on the "Book" button.
  • Proceed to the online payment of the tickets by accepting the general conditions of sale and validating the payment.

Payment methods: Payment by credit card or ANCV Connect through our bank server Payzen.
For payment by credit card: the customer must enter his 16-digit credit card number, the expiry date of his credit card and the verification code on the back of his card. He/she must then click on validate to pay for the service.

For payment by ANCV Connect, the customer must log in with their ANCV Connect identifiers to proceed with the payment.

Finalization of the order: the customer receives by email an acknowledgement of payment with the references and the amount of the transaction. The customer also receives an email with their order, which they must keep until their visit to the Clamouse cave. They must present this order in digital or paper format to the guide during their visit.

The Customer’s attention is particularly drawn to the method of acceptance of the order placed on the website www.clamouse.com

The “double click" and the checkbox on the acknowledgment and acceptance of the general conditions of sale, validating the order corresponds to an “electronic signature" and is equivalent to a handwritten signature.

They constitute an irrevocable and unreserved acceptance of the order by the Customer.

Unless proven otherwise, the data recorded by la grotte de Clamouse on the Internet or by phone constitute proof of all transactions between the company and its customers.

The information communicated by the Customer when placing the order commits them.

In application of article 1127-2 of the Civil Code, the customer can preview their order, in the form of a summary showing the total price and may modify their shopping basket before the final confirmation of the order.

The company reserves the right to refuse any order from a customer with whom there is or would have been a dispute over the payment of a previous order.

During any check at the entrance and on the way to the visit to the Cave or the Speleopark, a valid official photo ID (passport, identity card, driver’s license, residence card) may be requested to identify the buyer of the e-tickets and to check the eligibility of the e-ticket holders at the different fares and Speleopark routes. For this purpose, it is recalled:

  • That the Speleopark 1 “Emotion" is only suitable for visitors aged 8 years and over and subject to a minimum height requirement for Health & Safety reasons: a height of 150 centimeters with arms raised and a maximum weight of 120 kilograms;
  • That the Speleopark 2 “The big thrill" is only suitable for visitors aged 12 years and older and subject to a minimum height requirement for Health & Safety reasons: a height of 150 centimeters with arms raised and a maximum weight of 100 kilograms;
  • That all our discounts are only applicable on presentation of the associated receipts and that in case of non presentation of the receipts, the amount of the discount will have to be paid on the spot by the Customer.
  • That all reservations with free tickets (specific promotional codes) must be justified at the physical reception of Clamouse at least 15 minutes in advance. If this time limit is not respected, the Grotte de Clamouse reserves the right to put the reserved places back on sale.

The cave of Clamouse declines any responsibility for the anomalies that may occur during the ordering, processing or download order of internet tickets downloadable by the customer.

The Customer declares to have full legal capacity to engage under these terms and conditions of sale.

Article 4 – STORED PERSONAL DATA

In accordance with law n ° 78-17 of 6 January 1978 modified, relative to files and freedoms, there is at any moment a right of access, rectification or opposition which can be exercised at any time. moment with our company represented by Mrs. Nicole DUBOIS and Mr Guilhem DUBOIS.

Article 5 – AVAILABILITY

Product and price offers are valid as long as they are visible on the site, while stocks last.

The order of a visit ticket of the Cave is valid for the current year. For example, a ticket purchased on 10 February 2021 is valid until 31 December 2021, except in case of closure of the cave for holidays. The order cannot be taken back, exchanged or refunded.

The order of a Speleopark ticket is only valid for the date selected by the customer. It will not be returned, exchanged or refunded.

Article 6 – PAYMENT

Cash on the day of the order. Payment is by credit card or by ANCV connect.

The order will be considered accepted by the seller only when the banking centers concerned, have given their agreement and the seller has validated the order against its criteria for accepting risks.
In case of acceptance of the file by the payment center and the seller, the customer will be informed by sending the confirmation of the order by email.

In case of refusal of the file, the order will be automatically refused and the customer will also be informed by email.

The payment by credit card allows the customer to buy the tickets online immediately in a firm and definitive way, being specified that only one mode of payment is authorized by order. The accepted credit cards are those of the “Carte bleue", “Visa" and “Mastercard" networks currently valid.

Article 7 – CANCELLATION – REFUND

No right of withdrawal: pursuant to Article L121-21-8 of the Consumer Code, the services offered by la Grotte de Clamouse, as leisure services, are not subject to the application of the right of withdrawal provided for in articles L121-21 et seq. of the same Code, regarding remote selling.

An e-ticket can not be refunded even in case of loss or theft, nor returned or exchanged.

La Grotte de Clamouse reserves the possibility of modifying the hours of guided visit or closing the site at any time, in particular in the concern to preserve the safety of the visitors and / or the employees.

In case of cancellation or postponement of the services, the Customer agrees to be contacted by la Grotte de Clamouse at the address details entered when ordering to arrange another date of guided tour, Speleopark or Serious Game. In any case, the Customer can not claim any compensation.

Article 8 – SECURITY

PCI DSS is a standard jointly written by the Carte Bleue / Visa and EuroCard / MasterCard networks. It includes recommendations to ensure the security of confidential information held by companies, such as credit card numbers.

  • The credit card number is entered on a secure page hosted by the bank, so it is not known to the merchant.
  • The information is encrypted and follow the 3D Secure authentication protocol
  • The card number is never printed entirely on payment slips.

Article 9 – INTELLECTUAL PROPERTY

All texts, comments, works, illustrations, images and photographs, trademarks and databases reproduced and embedded on the site www.clamouse.com are protected by intellectual property rights and copyright.

DISPUTES AND LITIGATION

In compliance with Article L. 612-1 of the Consumer Code: “Every consumer has the right to free use of a consumer mediator for the amicable termination of the dispute with a professional."

Article 10 – RIGHTS APPLICABLE IN THE EVENT OF LITIGATION

The present general conditions of sale and the contract of online sale are subject to French law.

In the absence of an amicable resolution between the Parties, the dispute will be submitted to the competent courts in Montpellier (34).

Article 11 – RESPONSABILITY

The photographs reproducing products are not contractual.

An e-ticket cannot be reimbursed, even in the event of loss or theft, nor can it be returned or exchanged.
